Is H4-CBD Legal in the UK? Where can I buy it?

The world of cannabis and its myriad compounds can often seem like a complex landscape to navigate. In the forefront of these complexities lies a question frequently asked: “Is H4-CBD legal in the UK?” As a non-psychoactive cannabinoid, H4-CBD has drawn increasing interest over the years for its potential benefits, but legality is always a concern. This blog will delve into the legalities of H4-CBD in the UK, focusing on the Psychoactive Substances Act and the Misuse of Drugs Act.

Before we dive into the legal landscape, let’s understand what H4-CBD is. It’s a type of cannabinoid – a chemical compound found naturally in cannabis plants. But unlike THC, the compound responsible for the ‘high’ associated with cannabis, H4-CBD is non-psychoactive. This means it doesn’t produce a mind-altering effect, making it a popular choice for those seeking the potential therapeutic effects of cannabis without the intoxication.

H4-CBD & the Psychoactive Substances Act

In 2016, the UK implemented the Psychoactive Substances Act, which was initially designed to address the issue of ‘legal highs’ – substances that mimic the effects of illegal drugs but were previously legal due to technicalities in the law. The Act prohibits the production, supply, and importation of ‘new psychoactive substances’.

The term ‘psychoactive’ is key here, defined by the Act as a substance that can produce a ‘psychoactive effect’ in a person by affecting their mental functioning or emotional state. But crucially, H4-CBD does not fit this definition. Since it’s non-psychoactive, H4-CBD does not alter mental functioning or emotional state, making it fall outside the scope of this Act.

H4-CBD is not prohibited by the Psychoactive Substances Act.

H4-CBD and the Misuse of Drugs Act

The Misuse of Drugs Act 1971, another significant piece of legislation, classifies drugs into three categories – Class A, B, and C, based on their perceived harm. Cannabis, including its psychoactive component THC, falls under Class B. However, the Act does not classify non-psychoactive cannabinoids such as H4-CBD.

In 2001, an amendment to the Act allowed for the legal use of some cannabinoid-based medicines. This amendment paved the way for the legality of non-psychoactive cannabinoids like CBD, CBG, CBC and of course H4-CBD.

H4-CBD is not prohibited by the Misuse of Drugs Act.

H4-CBD: Legal Status in the UK

As it stands, H4-CBD is legal in the UK. In 2021, the Food Standards Agency (FSA) laid out specific rules for CBD products, including H4-CBD, stating that any CBD product marketed for its therapeutic effects must have a valid ‘novel foods’ authorisation. As long as a company has this authorisation, they can legally sell H4-CBD.

In addition, for a CBD product to remain legal, it must contain no more than 1mg of THC or its equivalent per container, irrespective of size. As H4-CBD doesn’t contain THC, it meets this requirement.

Despite its legal status, it’s important to remember that the sale and marketing of H4-CBD still need to abide by the standards set out by the Medicines and Healthcare products Regulatory Agency (MHRA) and the Advertising Standards Authority (ASA). These rules ensure that CBD products, including H4-CBD, are not marketed with unproven health claims.

In conclusion

So, is H4-CBD legal in the UK? The answer is a resounding yes. As a non-psychoactive cannabinoid, H4-CBD falls outside the definitions of both the Psychoactive Substances Act and the Misuse of Drugs Act. And with the FSA’s 2021 regulations, as long as a product has a valid ‘novel foods’ authorisation and adheres to THC limits, it can be legally sold and used in the UK.

However, always ensure you’re buying from a reputable source that follows all necessary regulations. As we continue to navigate the exciting and ever-evolving world of cannabis and its compounds, it’s essential to stay informed and make conscious choices.

In the shifting landscape of cannabis law and medicinal applications, H4-CBD stands out as a beacon of potential, promise, and legality.
